Vialudi Consumer Health Data Privacy Policy

This policy explains how Vialudi LLC ("Vialudi") handles "consumer health data" as defined by:

  • the Washington My Health My Data Act;
  • Nevada's consumer health data law (NRS 603A);
  • Connecticut's consumer health data provisions; and
  • similar laws.

It supplements our Privacy Policy and applies to all US users.

Vialudi is not a health service. We do not ask for medical records or diagnoses. Some information you choose to share can still be health-related, and we protect it as described here.

1. Consumer health data we may collect

  • Accessibility needs you choose to share so we can tailor packing lists, planning or suggestions. Examples include mobility, sensory or dietary needs.
  • Health-related details you volunteer in LUDI conversations, notes, Memories or messages. We ask you not to include health details you don't need to share.
  • Inferences that could reveal health information. One example is taking part in a wellness-focused Event, where your participation is recorded for the feature you use. We do not create health inferences for advertising or profiling.

We do not collect biometric data, genetic data, or precise location near health-care facilities for any health-related purpose.

2. Sources

We collect this information directly from you. Some of it may appear in content other users share with you in the Service.

3. How we use it

We use consumer health data only to provide the specific feature you asked for. For example, we use it to tailor a packing list or planning suggestion to your accessibility needs, or to answer your LUDI request. We also use it to keep the Service secure and to comply with the law.

Consent. We collect and use it only with your consent, which we ask for separately at the point of collection. The one exception is where it is strictly necessary to provide a feature you requested.

What we never do with it. We do not use it for:

  • advertising or marketing;
  • training AI models; or
  • any unrelated purpose.

4. Sharing

We share consumer health data only:

  • with service providers that process it for us under contract. These include our hosting providers, and AI model providers when you include the information in a LUDI request. None of them may use it for their own purposes.
  • with the other people on a Trip, if you agree to the accessibility needs you stated for that Trip being used for its packing list. The suggestions appear on the list in your own words, and everyone with access to the Trip can see them. You can withdraw this at any time: suggestions you have not accepted then leave the list, and items already on it stay until someone removes them;
  • with a travel or activity provider you choose to engage, only if you ask us to pass on the relevant accessibility needs, and only with your separate consent; and
  • where required by law.

We do not share consumer health data with affiliates for their own use.

We do not sell consumer health data. We do not use geofencing around health-care facilities.

5. Your rights

You may, at any time:

  • confirm whether we collect, share or sell your consumer health data, and access it, including a list of the third parties and affiliates we have shared it with, and how to contact them;
  • withdraw consent for its collection or sharing;
  • delete it, including copies held by our service providers; and
  • appeal our decision on your request.

To exercise these rights, email support@vialudi.com with the subject "Health Data Request." You can also delete accessibility information in Settings, where available.

We respond within 45 days, and may extend by 45 more days where the law allows, with notice. We process deletion requests, including forwarding them to our processors, within the time the law requires. If we deny your request, you can appeal by replying to our response. We decide appeals within 45 days. If you are not satisfied, you may contact the Washington, Nevada or Connecticut Attorney General, or your own state's attorney general.

We will not discriminate against you for exercising these rights.
